A Disclaimer Trust is a type of trust often included in an estate plan to help married couples maximize federal estate tax exemptions and preserve family assets. This trust allows the surviving spouse the option to "disclaim" (or decline) a portion of the inheritance, which then passes into a separate trust for the benefit of the spouse and, ultimately, other beneficiaries, such as children.

By setting up a Disclaimer Trust, couples can adapt to changing tax laws or financial needs after the first spouse's death. If the estate value exceeds federal exemption limits, the Disclaimer Trust can help reduce the taxable estate and, thus, minimize federal estate taxes, preserving more wealth for heirs.
